{"id":49416,"date":"2024-10-07T16:38:48","date_gmt":"2024-10-07T14:38:48","guid":{"rendered":"https:\/\/www.hibyegoods.com\/refund-and-claims-policy\/"},"modified":"2025-05-19T21:00:00","modified_gmt":"2025-05-19T19:00:00","slug":"refund-and-claims-policy","status":"publish","type":"page","link":"https:\/\/www.hibyegoods.com\/en\/refund-and-claims-policy\/","title":{"rendered":"Refund and Claims Policy"},"content":{"rendered":"\n<h1 class=\"wp-block-heading\"><strong>Complaints Procedure<\/strong><\/h1>\n\n<p><strong>The Complaints Procedure is part of the Terms and Conditions<\/strong>.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Information for the Consumer<\/strong><\/h2>\n\n<ul class=\"wp-block-list\">\n<li>The Consumer has the right to withdraw from the Purchase Agreement within fourteen (14) days of receipt of the Goods. In the event that the subject of the Purchase Contract is several kinds of Goods or the delivery of several parts, this period shall run from the date of receipt of the last delivery of the Goods. Withdrawal from the Purchase Contract must be sent to the Operator (as the Seller) within the period specified in this paragraph.  <\/li>\n\n\n\n<li>If the Consumer withdraws from the Purchase Contract, he\/she is obliged to notify in writing his\/her bank account number for the refund of the purchase price for the Goods, which may be reduced if the legal reasons for this are met.<\/li>\n\n\n\n<li>If the Consumer withdraws from the Purchase Contract in respect of the Goods which are returned to the Operator damaged and\/or worn out, in particular if the original markings of the Goods (i.e. labels, stickers, etc.) are removed, the Consumer shall be obliged to reimburse the Operator for the costs of restoring the Goods to their original condition.<\/li>\n\n\n\n<li>In the event of the Consumer&#8217;s withdrawal from the Purchase Contract, the Operator is obliged to refund the purchase price to the Consumer without undue delay, no later than 14 days from the date on which the Consumer was informed of the decision to withdraw from the Purchase Contract.<\/li>\n\n\n\n<li>If the Consumer has received Goods consisting of movable items under the Purchase Contract, he is obliged to send them back to the Operator without undue delay, no later than 14 days from the date of withdrawal from the Purchase Contract, or to hand them over to the Operator at the address of the Operator&#8217;s premises or registered office. The time limit shall be deemed to have been observed even if the movable items are sent to the Operator no later than the last day of the aforementioned period. <\/li>\n\n\n\n<li>The Consumer shall be liable to the Operator for any diminution in the value of the Goods as a result of handling the Goods in a manner other than that necessary to familiarise the Consumer with the nature and characteristics of the Goods, including their functionality.<\/li>\n\n\n\n<li>The operator shall make use of the possibility of out-of-court resolution of consumer complaints. In the event of a complaint, Consumers may contact the relevant employee of the Operator free of charge via the email address <strong>office@hibyegoods.com<\/strong> <\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\"><strong>Complaints Procedure<\/strong><\/h2>\n\n<ul class=\"wp-block-list\">\n<li>The Operator shall be liable to the Consumer that the Goods are free from defects on receipt. This does not apply if the subject of the Purchase Contract is Goods with defects which the Operator, if known to him or, taking into account all the circumstances, should have been known to him, is obliged to notify to the Consumer. <\/li>\n\n\n\n<li>If the Goods contain defects, the Consumer has the right to demand delivery of new Goods without defects, unless this is unreasonable due to the nature of the defect, or if the subject of the Purchase Contract was the Goods with defects, which the Operator, if the defects were known to him or, taking into account all the circumstances, should have been known to the Consumer, notified to the Consumer. If the defect relates only to a part of the Goods, the Consumer may only request the replacement of that part of the Goods; if this is not possible, the Consumer has the right to withdraw from the Purchase Contract. <\/li>\n\n\n\n<li>The Consumer has the right to delivery of new Goods or replacement of a part of the Goods even in case of a removable defect, if the Goods cannot be used properly due to the recurrence of the defect after repair or due to a greater number of defects. In this case, the Consumer has the right to withdraw from the Purchase Contract. <\/li>\n\n\n\n<li>If the Consumer does not withdraw from the Purchase Contract or does not exercise the right to delivery of new Goods without defects, or to replacement of its parts or to repair of the Goods, the Consumer may demand a reasonable discount on the price of the Goods. The Consumer shall also be entitled to a reasonable discount on the price of the Goods if the Operator cannot deliver new Goods free from defects, replace a part of the Goods or repair the Goods, as well as if the Operator fails to remedy the defect within a reasonable time or if remedying the defect would cause the Consumer significant difficulties. <\/li>\n\n\n\n<li>The Consumer shall not be entitled to the right of defective performance if the Consumer knew that the Goods were defective prior to taking delivery of the Goods or if the Consumer caused the defect himself\/herself.<\/li>\n\n\n\n<li>The Operator&#8217;s liability for defects in the Goods does not extend to wear and tear of the Goods caused by their normal use, in the case of Goods sold for a lower purchase price to the defect for which the lower purchase price was agreed, in the case of used Goods to the defect corresponding to the degree of use or wear and tear that the Goods had when taken over by the Consumer, or if this results from the nature of the Goods.<\/li>\n\n\n\n<li>If the Goods are under warranty, the Consumer has the right to claim liability for defective performance within the warranty period.<\/li>\n\n\n\n<li>At the Consumer&#8217;s request, the Operator is obliged to provide the Consumer with a warranty certificate. If the nature of the Goods so allows, it is sufficient to issue the Consumer with a proof of purchase of the Goods containing the information that must be contained in the warranty certificate instead of the warranty certificate. <\/li>\n\n\n\n<li>In the event that the Consumer exercises his right to eliminate defects in the Goods by repairing them, in the case of Goods for which a businessman other than the Operator, whose registered office or place of business is in the same place as the Operator or in a place closer to the Consumer for the purpose of warranty repairs, is designated, the Consumer shall exercise the right to warranty repairs with this businessman.<\/li>\n\n\n\n<li>Complaints about the Goods, including the removal of defects of the Goods, must be handled without undue delay, no later than 30 days from the date of the complaint, unless the Operator and the Consumer agree on a longer period of time. After the expiry of this period, the Consumer shall have the same rights as if it were a material breach of the Contract. <\/li>\n\n\n\n<li>The time limit for processing the complaint does not expire if the Operator has not received from the Consumer all the documents necessary for the processing of the complaint, until the documents are delivered.<\/li>\n\n\n\n<li>The Operator or the entity designated by the Operator shall, after the proper handling of the complaint, invite the Consumer to take delivery of the repaired Goods.<\/li>\n\n\n\n<li>For a proper assessment, it is necessary that the goods claimed are clean, complete and in compliance with the hygiene regulations or general hygiene principles.<\/li>\n\n\n\n<li>When using the goods, the consumer is obliged, in addition to the generally known rules, to observe the conditions set out for the use of the goods in the warranty card or in the instructions for use, to use and care for the goods in accordance with their natural lifetime<\/li>\n\n\n\n<li>The right to claim the rights from defects of the Goods shall be extinguished in case of unprofessional assembly or unprofessional commissioning of the Goods, as well as in case of unprofessional handling of the Goods, i.e. in particular in case of use of the Goods in conditions that do not correspond to the parameters specified in the documentation for the Goods.<\/li>\n\n\n\n<li>The right to exercise the right of withdrawal from the contract of sale and the right to complain about the Goods shall be extinguished if the consumer violates the following provisions:  \n<ul class=\"wp-block-list\">\n<li>For a proper assessment, it is necessary that the goods claimed are clean, complete and in compliance with the hygiene regulations or general hygiene principles.<\/li>\n\n\n\n<li>When using the goods, the consumer is obliged, in addition to the generally known rules, to observe the conditions set out for the use of the goods in the warranty card or in the instructions for use, to use and care for the goods in accordance with their natural lifetime<\/li>\n\n\n\n<li>The right to claim the rights from defects of the Goods shall be extinguished in case of unprofessional assembly or unprofessional commissioning of the Goods, as well as in case of unprofessional handling of the Goods, i.e. in particular in case of use of the Goods in conditions that do not correspond to the parameters specified in the documentation for the Goods.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\"><strong>Alternative dispute resolution<\/strong><\/h2>\n\n<ul class=\"wp-block-list\">\n<li>The Customer &#8211; Consumer &#8211; has the right to contact the Operator &#8211; Seller with a request for redress by e-mail to <strong>complaint@hibyegoods.com<\/strong> if he is not satisfied with the manner in which the Seller has handled his complaint or if he believes that the Seller has violated his rights. If the Seller responds to this request in a negative manner or fails to respond within 30 days of sending it, the Consumer has the right to submit a proposal for the initiation of alternative dispute resolution to an alternative dispute resolution entity (hereinafter referred to as ADR entity) pursuant to Act No. 391\/2015 Coll., Act No. 391\/2015 Coll., Act No. 391\/2015 Coll.     391\/2015 Coll.<\/li>\n\n\n\n<li>Consumers can also lodge a complaint via the RSO&#8217;s alternative dispute resolution platform, which is available online at: <a href=\"http:\/\/ec.europa.eu\/consumers\/odr\/index_en.htm\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">http:\/\/ec.europa.eu\/consumers\/odr\/index_en.htm.<\/a><\/li>\n\n\n\n<li>Alternative Dispute Resolution can only be used by a Consumer &#8211; a natural person who does not act within the scope of his business, employment or profession when concluding and performing a consumer contract. Alternative Dispute Resolution applies only to a dispute between the Consumer and the Seller arising out of or related to a consumer contract. Alternative dispute resolution applies only to distance contracts. Alternative dispute resolution does not apply to disputes where the value of the dispute does not exceed EUR 20. The ADR entity may require the Consumer to pay a fee for the initiation of ADR up to a maximum of EUR 5 including VAT.    <\/li>\n<\/ul>\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Complaints Procedure The Complaints Procedure is part of the Terms and Conditions.
